My 22 year old client was caught with a 23 pounds of "pot" which were hidden in a secret compartment of his SUV. (It's a separate violation to have a hidden compartment in your car to transport controlled substances). After hiring my law firm, he only did 11 days in jail. THATS ALL! Client was arrested for attempting to engage in a lewd act with a minor (PC 288) but never got within 10 feet of the “decoy” before he was tipped off that the whole thing was a set up. I was able to get the charges reduced to attempting to solicit a minor through the internet with no jail time because the Client refused to go to trail. Client was facing 7 years of state prison for felony grand theft (PC 487) for stealing from his employer which allegedly resulted in a $100,000 loss. Mr. Devitt hired an expert that showed that the loss was ½ what the employer said it was and he also got the client probation; then Mr. Devitt was able to get the probation transferred to his home state.
Young lady from the South was arrested for assault with deadly weapon (PC 245) and domestic violence (PC 243) after she allegedly smashed a can into her boyfriends face, causing quite a lot of blood and a scar which the D.A. had pictures of. I was able to convince the D.A. that my client did not understand that mixing and vodka or another type of alcohol creates a perception problem that she did do not know how drunk she was getting that she had never been in trouble before and that there was a “back story” as to what happened at the start of the fight. Her case will be dismissed after attending 10 Anger Management Sessions.
Woman was arrested for Felony PC 487 (Grand theft over $400) and Commercial burglary (PC 459) though it was a simple shoplifting case. I was able to show the prosecutor that she was elderly, from out of state and had never been in trouble before as well as that she had medical issues. Once she does some community service online the case will be dismissed. The is similar to cases where I gotten the charges reduced to trespassing and then had the case dismissed after a year of probation under PC 1203.4 or just has the charges reduced, probation terminated (sometimes early) and the case dismissed.
