Federal and state drug possession laws make it a crime to willfully possess illegal controlled substances such as:
- "designer drugs"
These laws also criminalize the possession of "precursor" chemicals such as iodine and Sudafed used in manufacturing, as well as paraphernalia related to drug use.
Drug possession laws vary according to drug type, amount, and geographic area of the offense. Possession of small quantities may be deemed "simple" possession, while possession of large amounts may result in a charge or presumed "possession with intent to distribute." For example, if the Defendant is caught with over 500 grams of "a controlled substance" he will likely be subject to Federal prosecution which will involve a sentence of 10 years in a Federal Penitentiary. However, we may be able to get him into the "safety valve" program, which would reduce any penalties, including the 10 years. Call us for further details.
Many times we can get "possession for sale" cases reduced to just "possession" and then get our clients into a "drug diversion" program. Successful completion will take the felony off your record as if you were never arrested.
